Under Section 8 (2) b) of Act LXXIV of 2016 on the protection of the townscape, the local government may give an opinion on an application for a building permit before the building permit procedure specified in a government decree.
The detailed rules are set out in the chapter “Townscape opinion procedure” (Section 18/B) of Government Decree 314/2012 (XI. 8.) on the urban development concept, the integrated urban development strategy and urban planning instruments, and on certain special urban planning legal instruments, Sections 44–45 of Government Decree 419/2021 (VII.15.) on the content of town plans, the procedure for preparing and adopting them, and certain special urban planning legal instruments, and Chapter VII “Townscape opinion procedure” of the ETKR.
