What is the Register of Instructions?
The Register of Instructions (RNY) is a central electronic administration service (KEÜSZ) regulated by Act CCXXII of 2015 on the general rules of electronic administration and trust services (E-Administration Act), which records the electronic administration instructions of natural persons and organizations.
What is the purpose of the RNY?
In line with the purpose of the E-Administration Act, the RNY makes it possible for clients to record their administrative instructionsand legal declarations electronically as private documents of full probative value, which are available in one register to clients and to the bodies entitled or obliged to access them.
Who can be RNY clients?
Administrative instructions can be made by adult natural persons and business organizations. On behalf of entities other than natural persons, a natural person with the right of representation may act when making an instruction, after successful identification of the organization and verification of the right of representation.
A further condition for using the RNY is that the natural person is included in one of the basic personal registers (personal data and address register, central immigration register, or the personal register of natural persons living abroad who use electronic administration).
What instructions can be made in the RNY?
The service makes it possible to record data and declarations related to contact, and to make further instructions regarding identification and the service that periodically notifies clients of their electronic administration actions.
The register also stores powers of attorney and other declarations recorded in instruction types available in the case catalog, and provides authenticated information about them without the need to present a paper document.
How can instructions be made in the RNY?
Clients can make administrative instructions electronically (online or by phone) or in person.
The first administrative instruction can be made electronically on the https://rendelkezes.gov.hu/rny-public/ website, or via the national telephone customer service (Government Customer Line) at 1818if the natural person client has one of the electronic identification services prescribed by law (Ügyfélkapu, an identity card with a storage element, facial image identification or Partial Code Telephone Identification).
Without electronic identification, registration can only be done in person, after identification of the natural person or business organization, at the following locations:
- at all government windows and document office customer service points in the country (http://kormanyablak.hu/hu), and
- at the Priority Customer Service offices of the National Tax and Customs Administration.
What is the first step if a client wants to use an RNY service?
In every case, the client must first record their legal declarations on contact in their so-called e-Profile. Here they can declare in what form and by what means the bodies providing electronic administration may reach them and send them deliveries with legal effect, as well as informational deliveries and notifications.
After making the contact instructions, further instructions can be made electronically (online or by phone) or in person.
Which bodies can query a client’s instructions?
The E-Administration Act defines the bodies obliged to provide electronic administration. In their procedures, these bodies must query and take into account the client’s instructions made in the RNY, for which they need to be connected to the RNY.
Instructions made in the RNY can only be applied in the administration of organizations already connected to the RNY.
You can view the bodies connected to the RNY, grouped by body type, HERE .
What declarations are available in each instruction type?
Natural persons can make the following instructions in the RNY:
- e-Profile instructions:
- Contact instructions:
- declaration choosing an electronic or non-electronic form of contact
- declaration on means of contact, including:
- declaration on the electronic address used for official contact,
- providing other electronic contact addresses for information purposes;
- other declarations related to electronic contact:
- excluding the bodies providing electronic administration from sending notifications or information (e.g. email, SMS) to other electronic contact details given to them by the client for information purposes. (Declaration under Section 15 (5) of the E-Administration Act);
- excluding the bodies providing electronic administration, in the absence of an official contact address, from sending deliveries (decisions or information) to other electronic contact details of the client known to them (e.g. an email address). (Declaration under Section 15 (3) of the E-Administration Act – for natural persons only);
- excluding the bodies providing electronic administration from sending the client, electronically, the summary prepared of declarations made by the client with content that cannot be proven later (e.g. by phone) and of the essential circumstances of the electronic contact. (Declaration under Section 16 (3) of the E-Administration Act)
- Identification instruction
- Instruction related to the notification service
- Contact instructions:
- Powers of attorney:
- general power of attorney
- transaction-specific powers of attorney
(for matters available in the case catalog, as a power of attorney or free-text power of attorney type, depending on the settings of the acting body)
- Free-text instructions
(if the acting body provides this in its case catalog)
For entities other than natural persons, a narrower range of instruction types is available under the e-Profile – in line with the provisions of the E-Administration Act.
How can powers of attorney made in the RNY be used?
Unless the law requires the client to act in person, their legal representative or a person authorized by them or by their legal representative may act instead, and the client and their representative may also act together. If the client makes a power-of-attorney instruction in the RNY for a procedure before a given body, no separate paper power of attorney needs to be prepared later for procedures before the body named in the power of attorney.
Powers of attorney recorded in the RNY can also be used for non-electronic administration by referring to the instruction, and are binding on acting bodies connected to the RNY. In this case there is no need to print the power of attorney made in the RNY; a reference to it is sufficient.
How are instructions approved in the RNY?
A power-of-attorney instruction can also be prepared by the authorized person, and then approved by the person giving the instruction; it is also possible to create a power-of-attorney type that takes effect upon acceptance , and for instructions made by representatives of business organizations with joint power of representation to be approved one after the other as well.
In the dedicated menu item, clients can check and validate their instructions awaiting approval, that is, all instructions whose validity – for the reasons detailed above – requires their approval.
The RNY also specifically alerts the clients concerned to this.
What can be declared regarding identification?
A natural person can specify how a body may identify them in the future during electronic administration. Identification methods include Ügyfélkapu, facial image identification via video link, Telephone Identification, and identification using an identity card with an electronic storage element (chip) issued after January 1, 2016 (the so-called eSzemélyi).
What is an official contact address?
An official contact address is a secure delivery service address to which a body providing electronic administration can send deliveries with legal effect. For natural person clients, this is, for example, the so-called KÜNY storage (formerly: Ügyfélkapu storage).
A natural person client can declare that they have electronic storage and register it as their official contact address.
In line with the obligation set out in the E-Administration Act, business organizations must record their official contact address in the RNY among the organizational contact instructions under the organization’s e-Profile. This may differ by organization type, distinguishing cooperating bodies with an office storage (Hivatali kapu), other business organizations with a Cégkapu, and sole proprietors with KÜNY storage as special business organizations.
What can the client declare under the periodic notification service?
The primary purpose of the periodic notification service is to give clients reliable information about electronic (administrative) actions taken in their name and about the electronic processing of their data. The notification is most comparable to a bank statement, which lets clients track their electronic activities and matters.
The essence of the service is that, within the legal framework, clients can specify in the RNY the bodies and electronic administration actions about which they wish to be notified. In their instruction, they can also set the notification period and where notifications are sent. Currently, notifications can be requested in connection with Telephone Identification.
Why is the RNY useful?
The RNY is useful because:
-
it enables faster and more efficient administration;
-
contact with authorities becomes more predictable and easier to plan
-
the register stores declarations on powers of attorney and provides authenticated information about them without the need to present a paper document.
To use the RNY service, you must first accept the General Terms and Conditions, which set out the rules for using the service.
Please note that the method of administration prescribed by law may override instructions made in the RNY!
